Terms of Service
These Terms govern your use of the NearHalo app and related services.
1. The service and its limits
NearHalo is a family wellness and care-coordination service. It can help authorized caregivers view available wellness, location, device, and alert information from connected devices and coordinate with a care team.
Not medical advice or a medical device
NearHalo is for general wellness awareness and caregiving coordination. It is not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. Information shown in NearHalo may be inaccurate, delayed, incomplete, or unavailable. Consult a qualified healthcare professional for medical decisions.
Not an emergency service
NearHalo does not contact emergency services, dispatch first responders, or guarantee alert delivery. In a medical or safety emergency, call 911 or the appropriate local emergency number immediately. Do not wait for or rely on a NearHalo alert.
2. Eligibility and consent
You must be at least 13 years old to create a NearHalo account. If you are under the age of majority where you live, you must have permission from a parent or legal guardian.
If you create a care profile, invite a care-team member, pair a device, or enable monitoring, you represent that you have the authority and all permissions or consents required to do so. You must not use NearHalo to monitor, track, harass, or surveil anyone without their knowledge and lawful authorization.
3. Accounts and care teams
You are responsible for keeping your account credentials secure and for activity under your account. Please notify us promptly at info@josephpagan.com if you believe your account has been used without authorization.
Care-team members may be able to view the data made available for the care profile they are authorized to access. Review your care-team membership regularly. Removing a member or using the recipient device’s Stop Sharing control affects future access and reporting as described in the app.
4. Your responsibilities
You agree to use NearHalo lawfully and responsibly. You may not interfere with the service, try to access information you are not authorized to see, reverse engineer the service except where law permits, or use it for unlawful surveillance or harassment.
You are responsible for evaluating available information, maintaining appropriate in-person care and emergency plans, and making your own decisions about whether to contact a caregiver, healthcare professional, or emergency services. Connected devices, permissions, network access, battery, and operating-system behavior can affect whether information is available.
5. Third-party services
NearHalo may rely on third-party platforms and services, including Apple Health, Apple Push Notification service, and Supabase. Their availability, accuracy, and performance are outside our control, and your use of them may be subject to their terms and policies.
6. Privacy
Our Privacy Policy explains how NearHalo processes personal, health, location, device, and care-team information. By using NearHalo, you acknowledge that you have read the Privacy Policy.
7. Ownership
NearHalo and its software, design, brand, and content are owned by NearHalo or its licensors and are protected by applicable intellectual-property laws. You receive a limited, personal, non-transferable right to use the service in accordance with these Terms.
8. Disclaimers and limitation of liability
To the maximum extent permitted by law, NearHalo is provided “as is” and “as available.” We do not guarantee uninterrupted operation, data accuracy, data freshness, device compatibility, alert delivery, or that the service will meet every need.
To the maximum extent permitted by law, NearHalo and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or use arising from or related to the service.
To the maximum extent permitted by law, NearHalo’s total liability for any claim arising from or related to the service will not exceed the greater of the amount you paid to NearHalo for the service in the 12 months before the claim or $100 USD. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
9. Suspension, termination, and deletion
You may stop using NearHalo at any time. You may delete your account in the app through Settings → Account → Delete account. The effect of deletion is described in our Privacy Policy and Account deletion page.
We may suspend or terminate access if we reasonably believe these Terms have been violated, the service is being misused, or suspension is needed to protect NearHalo, users, or others.
10. Changes, law, and contact
We may change these Terms from time to time. We will update the date above and, if a change is material, provide notice through the app or by email when appropriate. Continued use after a revised version takes effect means you accept the revised Terms.
